Terms of Service

These Terms govern your use of MarketBotPro (the "Service"), a mobile application that delivers alerts about public listings on Facebook Marketplace and similar marketplaces. The Service is operated by Luke James, a sole trader based in the United Kingdom, contactable at marketbotpro123@gmail.com ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to create an account. If you are under 18 you may only use the Service with the permission of a parent or guardian.

2. Account

You are responsible for keeping your login credentials confidential and for any activity that happens under your account. Notify us promptly if you suspect unauthorised access.

3. Subscriptions and payments

The Service offers Basic, Premium, and VIP tiers billed monthly through Stripe. Prices and tier features are shown on the landing page at marketbotpro.org at the time of purchase. By subscribing you authorise us, through Stripe, to charge your payment method on a recurring basis until you cancel.

You can cancel at any time from inside the app or by emailing us. Cancellation takes effect at the end of the current billing period. Apart from where required by law, payments already taken are non-refundable.

4. What the Service does and does not do

MarketBotPro monitors public listings on supported marketplaces and pushes alerts to your device when listings match the criteria you set. We do not:

buy items on your behalf,
negotiate or message sellers on your behalf,
verify the accuracy, condition, ownership, or legality of any listing,
guarantee that any alert will result in a successful purchase.

Any decision to contact a seller, agree a price, exchange money, or meet in person is solely yours. We are not a party to any transaction between you and a seller.

5. Acceptable use

You agree not to:

resell, sub-license, or commercially redistribute the Service or its outputs,
attempt to reverse engineer, decompile, or extract source code from the Service,
scrape, mirror, or systematically download data from the Service through automated means,
use the Service to harass other users or to engage in fraudulent or unlawful activity,
share your account with others or use multiple accounts to circumvent tier limits.

We may suspend or terminate your account for breach of these conditions.

6. Third-party content

Listings shown in the app originate from Facebook Marketplace and other public marketplaces. We do not control that content, its accuracy, or whether the listings remain available. MarketBotPro is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., Facebook, Vinted UAB, or any other marketplace operator.

7. Intellectual property

The MarketBotPro name, logo, app, and all related materials are owned by us. You receive a limited, personal, non-exclusive, non-transferable licence to use the Service for the duration of your subscription. All other rights are reserved.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific listing will be detected.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability to you for any claim arising from or related to the Service is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for loss of profit, data, or business opportunity.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud.

10. Indemnity

You agree to indemnify and hold us harmless against any third-party claims, losses, or costs arising from your use of the Service in breach of these Terms or any applicable law.

11. Termination

You may delete your account at any time from inside the app. We may suspend or terminate your access if you breach these Terms or if we cease to operate the Service. Where the Service is discontinued and you have a paid subscription, we will refund the unused portion of the current billing period.

12. Changes

We may update these Terms from time to time. If a change materially affects your rights we will notify you in-app at least 14 days before it takes effect. Continued use of the Service after a change means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights in your country of residence.
